Terms of Service

1. Agreement

These Terms of Service govern the use of NodeMonster websites, portals, domain registration, DNS, hosting, email, SSL, cloud, support, and related services.

NodeMonster is the hosting, domains, DNS, and cloud services wing of Zoftcares Technologies. Depending on billing, customer location, service scope, and contracting arrangement, services may be delivered through Zoftcares Technologies or affiliated regional entities.

By creating an account, placing an order, registering a domain, using hosting, or accessing the portal, you agree to these Terms, the Privacy Policy, acceptable use rules, and any applicable service order.

2. Accounts and customer responsibility

Customers must provide accurate account, billing, registrant, and contact information and keep it up to date.

Customers are responsible for securing account credentials, users, DNS settings, hosting content, email accounts, applications, scripts, backups, and any activity under their account.

We may request verification, documents, ownership proof, or approvals before activating, transferring, restoring, or modifying sensitive services.

3. Domain services

Domain registrations, transfers, renewals, WHOIS/RDAP records, registrant changes, disputes, suspensions, and cancellations are subject to registry, registrar, ICANN, and country-code domain authority policies.

A domain search result does not guarantee registration. Availability, pricing, premium classification, policy restrictions, and registration eligibility may change until the registry or registrar confirms the order.

Customers must submit accurate registrant contact information. Incorrect or outdated details may lead to suspension, verification failure, transfer lock, cancellation, or loss of the domain.

Domain renewals are the customer responsibility unless an active auto-renewal or managed renewal arrangement is confirmed. Expired domains may be subject to redemption fees, auction, release, or permanent loss.

4. Hosting, DNS, email, SSL, and cloud services

Hosting and cloud services are provided according to the selected plan, resource limits, technical requirements, and service order.

DNS, SSL, email, and hosting configuration changes may take time to propagate or activate. We are not responsible for downtime caused by incorrect customer configuration, third-party providers, registry issues, propagation delays, or external network failures.

Customers are responsible for website content, application code, licenses, backups, security updates, passwords, third-party plugins, and compliance with applicable laws.

5. Acceptable use

Services must not be used for spam, phishing, malware, botnets, denial of service attacks, credential theft, copyright infringement, illegal content, abusive scanning, fraud, impersonation, or any activity that harms networks, users, reputation, or infrastructure.

We may suspend, restrict, remove, rate-limit, or terminate services where abuse, legal risk, security risk, non-payment, registry action, or policy violation is suspected.

Customers must promptly respond to abuse, compliance, verification, or security notices.

6. Orders, billing, refunds, and taxes

Prices, currencies, taxes, government fees, registry fees, exchange rates, and third-party charges may change.

Domain registrations, renewals, transfers, premium domains, SSL certificates, custom setup, and third-party licenses are usually non-refundable once submitted, provisioned, or paid to an upstream provider.

Refunds, credits, or cancellations are handled according to the applicable service order, plan, payment method, upstream provider rules, and local law.

Customers are responsible for taxes, bank fees, payment gateway fees, chargebacks, and any costs caused by incorrect payment information or late payment.

7. Service changes and availability

We may modify, improve, suspend, retire, or replace features, plans, integrations, infrastructure, or third-party providers as needed for security, compliance, availability, business, or technical reasons.

We aim to provide reliable services, but no hosting, DNS, domain, email, or cloud service can be guaranteed to be uninterrupted, error-free, or immune from external incidents.

8. Data, backups, and customer content

Customers should maintain independent backups of websites, databases, DNS records, emails, files, and business-critical content unless a specific managed backup service is included and confirmed.

We may remove or disable content that violates these Terms, applicable law, intellectual property rights, acceptable use rules, or upstream provider requirements.

9. Limitation of liability

To the maximum extent permitted by law, NodeMonster, Zoftcares Technologies, and affiliated entities are not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages.

Our aggregate liability for a paid service is limited to the amount paid by the customer for the affected service during the period giving rise to the claim, unless applicable law requires otherwise.

10. Third-party services

Services may depend on registrars, registries, DNS providers, CDN providers, cloud infrastructure, payment providers, messaging providers, software vendors, and other third parties.

Third-party terms, policies, outages, abuse decisions, compliance rules, pricing, and technical limits may apply to your services.

11. Governing terms and updates

We may update these Terms from time to time. Continued use of the services after updates means you accept the updated Terms.

If a separate written agreement or service order conflicts with these Terms, the written agreement or service order controls only for the specific conflict and service scope.

12. Contact and notices

Official notices and support requests should be submitted through the customer portal or official NodeMonster support channels. We may send service, security, billing, renewal, and legal notices to the account email on file.
